Terms of Use
Last updated:
These terms govern the use of Alquimista, including the dashboard at alquimista.app, the Telegram bot and the integrations with other platforms. By using the service, you agree to them. If you use Alquimista on behalf of an agency or brand, you confirm that you are authorized to accept these terms for it.
1. Who provides the service
Alquimista is run by Pollyana Gomes Melo, an individual resident in Spain (Barcelona). Contact: pollyana.pgm2@gmail.com.
In these terms, "we" means Alquimista. "Client" means the agency or brand that subscribes to the service. "User" means anyone who accesses the dashboard or sends content on the client's behalf.
2. The service
Alquimista helps agencies and brands produce content:
- it receives ideas through Telegram or upload, as text, audio, images or video;
- it transcribes and organizes those ideas and turns them into content plans and draft pieces for different channels, with the help of artificial intelligence;
- it provides a dashboard to review, edit, approve or discard each piece, and to share approval links with the brand;
- it builds Pin artwork from the brand's own images and publishes to Pinterest the Pins a person has approved;
- it shows analytics for connected accounts, such as Instagram and Pinterest.
The features available and usage limits (for example, pieces per month and months of history kept) depend on the client's plan.
3. Human review before publishing
This is a core principle of the service:
- All generated content is a draft until a person reviews and approves it in the dashboard.
- Nothing is published to a platform without a person's explicit approval of that specific piece. On Pinterest, approval is given Pin by Pin.
- Alquimista takes no automatic actions on connected accounts other than publishing what was approved and reading the data described in the Privacy Policy. It does not like, follow, comment, message or repost other people's content.
- The client can edit or discard any piece before approving it.
Whoever approves a piece is responsible for having checked its text, image, links and information.
4. Account and access
- The service is meant for professionals and businesses, not for consumers. You must be at least 18 years old.
- The client is responsible for the users it adds and for what they do in the dashboard.
- Each user must keep their password confidential and tell us at pollyana.pgm2@gmail.com if they suspect unauthorized access.
- We may ask for information to confirm the identity of anyone requesting access to, changes to or deletion of data.
5. Connecting other platforms
- A connection to Pinterest, Instagram or another platform happens only with the account owner's authorization, given on the platform's official screen.
- The client must follow the terms and rules of each platform it connects, such as Pinterest's rules for commercial content and Meta's platform terms.
- Authorization can be withdrawn at any time, on the platform itself or by asking us. Without it, features that depend on the connection stop working.
- We do not control third-party platforms. Changes, outages or restrictions on them may affect the service.
6. Client content
- The client remains the owner of the content it sends: ideas, text, photos, logos and trademarks.
- The client grants us a limited, non-exclusive, royalty-free license to store, process, adapt and publish that content only to provide the service to the client, for as long as the service lasts and for the retention periods in the Privacy Policy.
- The client confirms that it holds the rights to what it sends, including photos, product images, music and trademarks, and has permission from the people who appear in that material.
- The client may freely use the pieces generated for it, to the extent the law allows. Because AI can produce similar results for similar requests, we do not guarantee that a piece is unique.
7. Artificial intelligence
- Part of the content is generated with third-party AI models. AI output can contain errors, outdated information or inaccurate statements, which is why it goes through human review (section 3).
- The client is responsible for checking facts, prices, claims, legal notices and the suitability of each piece before approving it.
- We do not use client content or data from connected platforms to train AI models.
- Where a platform requires it, the client must label content generated or modified by AI.
8. Acceptable use
When using Alquimista, the client and its users agree not to:
- publish content that is illegal, misleading, defamatory, discriminatory, violent, sexually explicit or that infringes third-party rights;
- spam, publish repetitive content in bulk or try to manipulate reach on the platforms;
- use affiliate links or sponsored content without a clear disclosure of their commercial nature, as required by each platform's rules and the law;
- send sensitive data (such as health, religion or political opinions) or third-party data that the content does not need;
- use the service to act on an account without its owner's authorization;
- try to publish without human review, get around plan limits or bypass security controls;
- access, copy or test the system without authorization, reverse engineer it or overload the service;
- resell access to the service without a written agreement with us.
We may refuse, remove or decline to publish content that breaks these rules.
9. Plans, limits and payment
- Billing is monthly and in advance, by bank transfer or card. The price of each plan is the one in the commercial proposal accepted by the client.
- Each plan's limits (number of pieces, months of history, number of brands and posts per cycle) are stated in the proposal or in the dashboard.
- When a limit is reached, generation or publishing may pause until the next cycle or a plan change.
- Price changes will be announced 30 days in advance and apply from the first billing cycle after that period.
10. Data protection
How we handle personal data is described in the Privacy Policy. When the client is an agency that sends data about its own brands or their audiences, Alquimista processes that data as a processor on the client's behalf. If the client needs one, we can sign a data processing agreement (DPA).
The client is responsible for having a legal basis for the data it sends us and for informing the people concerned.
11. Availability and changes to the service
- We work to keep the service available, but we do not guarantee uninterrupted or error-free operation. There may be interruptions for maintenance or due to outages at providers or connected platforms.
- We may change, add or remove features. If a change removes an essential feature of the client's plan, we give reasonable advance notice.
- We keep daily backups, but the client should keep its own copies of any content it considers important. The dashboard allows data export.
12. Suspension and termination
- The client may stop using the service at any time by writing to pollyana.pgm2@gmail.com. Access continues until the end of the billing cycle already paid, and there is no pro-rata refund for the remaining period.
- We may suspend or terminate access with 15 days' notice, or immediately in case of a serious breach of these terms, non-payment, a security risk or a legal requirement.
- After termination, the client may request a data export for up to 30 days. After that, data is deleted as described in the Privacy Policy.
13. Limitation of liability
- The service is provided as is. The client is responsible for the decisions to approve and publish content and for the outcomes of those posts.
- We are not liable for indirect damages, loss of profits, lost opportunities or followers, or for the actions, outages or changes of third-party platforms.
- Our total liability in any case is limited to the amount the client paid us in the 12 months before the event that gave rise to the claim.
- Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence.
14. Indemnity
The client agrees to compensate us for third-party claims caused by content it sent or approved, by use of accounts without authorization or by a breach of these terms.
15. Changes to these terms
We may update these terms. The date at the top shows the latest version. Significant changes are announced through the dashboard or by email 30 days in advance. Continuing to use the service after that means accepting the new version.
16. Governing law and jurisdiction
These terms are governed by the laws of Spain. Any dispute will be settled by the courts of Barcelona, unless the law mandatorily sets a different venue.
